Customer Terms and Conditions

These Terms and Conditions govern the use of the Gadiyo mobile application operated by Birtik Tech Private Limited ("Company", "we", "our", or "us").

By downloading, installing, accessing, or using the Gadiyo application, you agree to these Terms. If you do not agree with these Terms, please do not use the application.

1. About Gadiyo

Gadiyo is a technology platform that allows users to:

• • Contact drivers or agencies
• • Request bookings for transportation

Gadiyo only provides a digital marketplace connecting customers with independent vehicle providers. The Company does not operate transportation services.

2. Independent Drivers

Drivers, agencies, and vehicle providers listed on the platform are independent third parties.

Birtik Tech Pvt Ltd:

• • does not employ drivers
• • does not own vehicles
• • does not control driver behavior

All transportation services are provided directly by drivers or agencies.

3. User Eligibility

To use the platform, you must:

• • be at least 18 years old
• • provide accurate registration information

Providing false information may result in account suspension.

4. Booking and Contact

Users may:

• • directly call vehicle providers
• • send booking requests through the app

Any agreement related to transportation is between the customer and the driver or agency. Birtik Tech Pvt Ltd is not a party to these agreements.

5. Payments

Payments may be made:

• • directly to the driver
• • through payment options available in the application

The Company is not responsible for payment disputes between users and drivers.

6. Ride Safety Disclaimer

Gadiyo does not track rides in real time.

Users acknowledge that:

• • rides are not monitored
• • safety is the responsibility of users

Customers should take necessary precautions for their own safety.

7. Criminal Activity Disclaimer

Birtik Tech Pvt Ltd is not responsible for criminal activities committed by any driver or user including but not limited to:

• • theft
• • assault
• • kidnapping
• • harassment
• • murder
• • illegal drug transport
• • fraud
• • smuggling
• • human trafficking

Any such activity should be immediately reported to local authorities.

8. Accident Disclaimer

The Company is not liable for accidents, injuries, or damages occurring during transportation.

This includes:

• • road accidents
• • vehicle damage
• • personal injury
• • death

All transportation services are provided by independent drivers or agencies.

9. Prohibited Activities

Users must not use the platform for:

• • illegal transportation
• • drug trafficking
• • carrying illegal weapons
• • harassment or abuse
• • criminal activities

Violation may lead to permanent account suspension.

10. User Responsibilities

Customers are responsible for:

• • verifying driver identity
• • confirming vehicle details
• • ensuring their own safety

The Company does not guarantee the identity, reliability, or conduct of drivers.

11. Dispute Resolution

Any disputes between customers and drivers must be resolved directly between the parties. Birtik Tech Pvt Ltd is not responsible for mediating disputes.

12. Limitation of Liability

To the maximum extent permitted by law, Birtik Tech Pvt Ltd shall not be liable for:

• • criminal activity
• • financial loss

arising from the use of the platform.

13. Account Suspension

We reserve the right to:

• • suspend accounts
• • terminate accounts
• • restrict access

if users violate these Terms.

14. Governing Law

These Terms shall be governed by the laws of India. Any disputes shall fall under the jurisdiction of courts located in Gujarat, India.
