By accessing, downloading, registering, or using the Platform, you acknowledge and agree to this Disclaimer.

1. Platform Nature

Gadiyo is only a digital marketplace platform that connects:

• • customers seeking transportation services
• • independent drivers, vehicle owners, or agencies

Birtik Tech Private Limited does not provide transportation services.

The Company:

• • does not own vehicles
• • does not employ drivers
• • does not operate rides
• • does not control driver behavior

All transportation services are provided by independent third-party partners.

2. No Transportation Responsibility

The Company acts only as a technology platform facilitating communication and booking.

Birtik Tech Pvt Ltd shall not be responsible for:

• • quality of transportation services
• • driver conduct
• • vehicle condition
• • delays in service
• • route decisions

3. No Ride Monitoring or Tracking

The Gadiyo platform does not provide real-time ride monitoring or tracking.

Users acknowledge that:

• • rides are not monitored by the Company
• • users interact directly with drivers
• • users travel at their own risk

Users are encouraged to take reasonable precautions to ensure their safety.

4. Independent Contractor Status

Drivers, agencies, and vehicle providers listed on the platform are independent contractors.

They are not employees, agents, or representatives of Birtik Tech Pvt Ltd.

The Company does not supervise or control their actions.

5. Criminal Activity Disclaimer

Birtik Tech Pvt Ltd shall not be responsible or liable for any criminal acts committed by any user, driver, partner, or third party including but not limited to:

• • robbery
• • kidnapping
• • harassment
• • assault
• • sexual assault
• • murder
• • theft
• • fraud
• • drug trafficking
• • smuggling
• • human trafficking
• • illegal transportation of goods
• • illegal weapons transport

If any illegal activity occurs, users must immediately contact local law enforcement authorities.

6. Personal Safety Responsibility

Users acknowledge that:

• • the Company cannot guarantee the identity or behavior of any driver or passenger
• • the Company does not conduct complete background checks on all users

Users are responsible for:

• • verifying driver or vehicle details
• • ensuring personal safety during rides

7. Accident and Injury Disclaimer

Birtik Tech Pvt Ltd shall not be liable for any accident, injury, damage, or loss occurring during transportation including but not limited to:

• • road accidents
• • vehicle breakdowns
• • personal injury
• • death
• • loss or theft of personal belongings

Transportation services are provided solely by independent drivers or agencies.

8. User Disputes

The Company is not responsible for disputes arising between:

• • customers and drivers
• • customers and agencies

Any disputes must be resolved directly between the involved parties.

9. No Guarantee of Service Quality

The Company does not guarantee:

• • availability of vehicles
• • quality of transportation services
• • reliability of drivers
• • punctuality of rides

10. Illegal Use of Platform

The platform must not be used for any illegal activities including:

• • transportation of illegal drugs
• • human trafficking
• • criminal activities
• • harassment or abuse
• • fraud or scams

Accounts involved in illegal activities may be permanently banned and reported to authorities.

11. Limitation of Liability

To the maximum extent permitted by law, Birtik Tech Pvt Ltd shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from the use of the platform.

This includes but is not limited to:

• • property damage
• • service disruptions

12. Assumption of Risk

By using the Gadiyo platform, users acknowledge that:
